Deficiencies

1) Title 9, Section 10563 Accountability Class B

The above section states, ‘The licensee, whether an individual or other entity, is accountable for the general supervision of the licensed facility, and for the establishment of policies concerning its operation.”

The provider was deficient in meeting the above regulation because the medication destruction policy states that prescription medications, left behind by residents will be destroyed every 90 days, however, the medication destruction log indicated that medications had not been destroyed since June of 2015.

2) Title 9, Section 10566(a)(c) Admission Agreements Class C

The above section states, in part, “Fees assessed in consideration for resident recovery or treatment services shall be addressed in individual/written agreements at time of admission (c) Such agreements shall be dated and signed by the resident and the licensee no later than seven (7) days following admission.”

The licensee was deficient in meeting the above regulation because there was no admission agreement in the participant file.

3) Title 9, Section 10567(a){b) Resident .Health Screening Class B

The above section states, “Every resident shall complete a health questionnaire which shall identify any health problems or conditions which require medical attention, or which are of such a serious nature as to preclude the person from participating in the program (b) Every resident shall be tested for tuberculosis under licensed medical supervision within six (6) months prior to or thirty (30) days after admission and annually thereafter if continuous participation is maintained.”

The licensee was deficient in meeting the above regulation because the file for Resident did not have a complete health screening questionnaire and the files for Resident were missing tuberculosis test results.

4) Title 9, Section 10568(b)(8) Resident Records Class C

The above section states, in part”Each record shall contain information including but not limited to the following: Record of any permitted current medication including the name of the person who prescribed the medication and instructions for its use.n

5) Title 9, Section 10581(a) Buildings and Grounds Class C

The above section states, in part, “Facilities shall be clean, safe, sanitary and in good repair at all times for the safety and well-being of residents, employees and visitors.”

The licensee was deficient in meeting the above regulation because the bathroom inside room 153 was in disrepair; The baseboard and plaster near the toilet were damaged; and the men’s shower had mold.

6) Title 9; Section 10564(c) Personnel Requirements Class C

The above section states, in part, “program staff who provide counseling services (as defined in Section
13005) shall be licensed, certified, or registered to obtain certification pursuant to Chapter 8 (commencing with Section 13000).”

The licensee was deficient In meeting the above regulation because employee did not have documentation of registration or certification with a certifying organization, nor was there any documentation of professional licensure.
