Deficiencies

1) Title 9, Section 10564(e)(1) Personnel Requirement Class B

The above section states, in part, “All personnel shall be In good health, good physical health shall be verified by a health screening including a test for tuberculosis.”

The licensee was deficient In meeting the above regulation because the employee file did not contain a health screening or an updated tuberculosis test, for:

• Employee numbers 1 and 4 – was missing health screenings;
• Employee – was missing a current tuberculosis test.

2) Title 9, Section 10564(k) Personnel Requirement Class C

The above sections on states, in part, “The licensee shall develop, maintain, and Implement an ongoing training program for all staff in the nonresidential section 105•64(b)(3) of this sub chapter in addition to specific training related to their duties.”

The licensee was deficient in meeting the above regulation because the program did not have documentation of a developed, maintained and implemented ongoing training program for all staff.

3) Title 9, Section 10565(a) Personnel Records Class C

The above section states, in part, “Personnel records shall be completed and maintained for each employee, shall be available to the department for review.

The licensee was deficient in meeting the above regulation because the employee file did not contain the following documentation, for:

• Employee # 2 – was missing a resume;
• Employee #’s 1 and 2 – missing job descriptions

4) Title 9, Section 10572(b) Health-Related Services Class B

The above section states, in part, “During the provision of alcoholism or drug abuse recovery or treatment services as defined in section 10501(a) of this sub chapter there shall be at least one person in the facility who is capable of providing cardiopulmonary resuscitation (CPR) and First Aid.”

The licensee was deficient.in meeting the above regulation because the employee file did not contain documentation of the employee being capable of providing CPR or First Aid during the provision of treatment, for: Employee #2.

5) Title 9, Section 10567(b) Resident Health Screening Class B

The above section states, in part, “Every resident shall be tested for within six (6) months prior to or thirty (30) days after admission and annually thereafter.”

The licensee was deficient in meeting the above regulation because the residents were not tested for tuberculosis within 6 months prior to or 30 days after admission for Residents.

6) Title 9, Section 10581(a) Building and Grounds • Class C

. The above section states, in part, “Facilities shall be clean, safe, sanitary and in good repair at all times for the safety well-being of residents, employees and visitors.”

The licensee was deficient in meeting the above regulation because the program is not clean, safe, sanitary, and/or has damage in the following areas:

• The car pet throughout the facility was worn out excessively,dirty with black grime and debris.
• The treatment room wall paint was chipping and peeling.
• The walls were damaged excessively on the far side of the dining room it was exposing sheet rock.
• There ceiling were stained from water damage in the classroom hallway near the restrooms.
• There was a 5″ hole in the classroom wall.
• The classroom ceiling and walls were water damaged.

7) Title 9, Section 10584(b) Fixtures, Furniture, Equipment and Supplies Class B

The above section states, in part, “All windows screens shall be in good repair.”

The licensee was deficient in meeting the above regulation because of the following:

• Window screens around the facility were damaged.
• The window was broken/cracked in the classroom.
• The blinds throughout the facility were damaged or missing slats

8) Title 9, Section 10584(e) Fixtures, Furniture, Equipment and Supplies Class B

The above section states, in part, “All toilet, hand washing facilities shall be maintained in safe and sanitary operating conditions.”

The licensee was deficient in meeting the above regulation because of the following:

• The ventilation in the facility was unusually stuffy, hot, and humid,
• The laundry room had insufficient lighting.
• Kitchen light switch fixture was broken,
• The classroom had an electrical outlet cover missing

9) Title 9, Section 10584(e) Fixtures, Furniture, Equipment and Supplies Class C

The above section states, in part, “All toilets, hand washing and bathing facilities shall be maintained in safe and sanitary operating conditions.”

The licensee was deficient in meeting the above regulation because the program is not clean, safe, sanitary, and/or has damage in the following bathing areas:

Staff bathroom
• Tile floor and wall was dirty, Detox bathroom
• Shower curtain dirty,

• Shower was mildewed.
• Paint was chipping and peeling.
• Metal stall was breaking apart from being damaged by rust corrosion.
• Toilet was dirty with green mildew.
• Bathroom tile was excessively dirty with black grime, mildew, black markings, and urine. Treatment bathroom
• Tiles were broken.
• Shower curtain dirty.
• Shower was mildewed,
• Tile floor and wall was dirty. Classroom Section
• Women’s bathroom had a 5″ hole in the wall behind the door.

10) Title 9, Section 10584(f)(1) Fixtures, Furniture, Equipment and Supplies Class C

The above section states, in part, ”All containers used for storage of solid waste shall have tight-fitting covers shall be in good repair, leak proof, and rodent proof.”

The licensee was deficient in meeting the above regulation because the containers around the facility used for storage of solid waste did not have a tight-fitting cover.
