Deficiencies

1) Title 9, Section 10563 Accountability Class B

The above section states, “The licensee, whether an individual or other entity, is accountable for the general supervision of the licensed facility, and for the establishment of policies concerning its operation.”

The licensee was deficient in meeting this regulation because of the following:
• Over count of prescribed medications
• Medication not properly documented
• Medication was not verified by count upon entry into the facility

2) Title 9, Section 10565(a)(6) Personnel Records Class C

The above section states, “Personnel records shall be completed and maintained for each employee, shall be available to the department for review, and shall contain the following information: (6) Duty statement.”

The licensee was deficient in meeting this regulation because a duty statement was missing for employee

3) Title 9, Section 10566(a) Admission Agreement Class B

The above section states, “Fees assessed in consideration for resident recovery or treatment services shall be addressed in individual written agreements at time of admission.”

The licensee was deficient in meeting this regulation because fees assessed for services provided were missing for client .

4) Title 9, Section 10566(c) Admission Agreement Class B

The above section states, in part, “Such agreements shall be dated and signed by the resident and the licensee no later than seven (7) days following admission.”

The licensee was deficient in meeting this regulation because the admission agreement was missing from client .

5) Title 9, Section 10569 Personal Rights Class B

The above section states, in part, “Each resident shall have personal rights. ”

The licensee was deficient in meeting this regulation because personal rights was missing from client.

6) Title 9, Section 10581(a) Building and Grounds Class C

The above section states, “Facilities shall be clean, safe, and sanitary and in good repair at all times for the safety and well-being of residents,employees and visitors. ”

• Light not working in downstairs living room

1) Section 19005(b)(2)(3)(4)(6) Personnel Policies

The above section states, “The program shall maintain minimum personnel files on all employees. Each personnel file shall contain: (2) Employment confirmation statement; (3) Job description; (4) Salary schedule and salary adjustments; (6) Health records including a health screening report or health records, and tuberculosis test as required.”
