Deficiencies

1) Title 9, Section 10564(e)(1) Personnel Requirement Class B

The above section states, in part, “All personnel shall be in good health good physical health shall be verified by a health screening, including a test for tuberculosis.”

The licensee was deficient in meeting the above regulation because the employee file did not contain a health screening, for: Employee #’s 2 and 11.

2) Title 9, Section 10564(k) Personnel Requirement Class C

The above section states, in part, “The licensee shall develop, maintain, and implement an ongoing training program for all staff in the areas identified in section 10564(b)(3) of this sub chapter in addition to specific training related to their duties.”

The licensee was deficient in meeting the above regulation because the program did not have documentation of a developed, maintained and implemented ongoing training program for all staff.

3) Section 10564 (L)(3)(A) Personnel Requirement

The above section states, in part, “shall demonstrate abilities and competency.”

The licensee Was deficient In meeting the above regulation because the personnel record did not contain documentation of licensure, certification, or registration to obtain certification pursuant to Chapter 8, .Section 13035 (f), for. Employee #6.

4) Title 9, Section 10565(a) Personnel Records Class C

The above section states, in part, “Personnel records shall be completed and maintained for each employee shall be available to the department for review.”

The licensee was deficient in meeting the above regulation because the personnel record did not contain documentation of job description/duty statement, for: Employee#2.

5) Title 9, Section 10567(b) Resident Health Screening Class B

The above section states, in part, “Every resident shall be tested for…within six (6) months prior to or thirty (30) days after admission and annually thereafter.”

The licensee was deficient in meeting the above regulation because the residents were not tested for tuberculosis within 6 months prior to or 30 days after admission.

6) Title 9, Section 10571(c) Transportation Class C

The above section states, in part, “Motor vehicles used to transport residents shall be maintained in a safe operating condition.”

The licensee was deficient in meeting the above regulation because the Chevy Van 7 passenger vehicle, used to transport residents was not maintained in a safe operating condition because the front tires were balding, dangerous, and hazardous to the clients’ and employees’ safety.

7) Title 9, Section 10572(b) Health Related Services Class C

The above sections states, in part, “during the provision services there shall be at least one person in the facility who ls capable of providing cardiopulmonary resuscitation and first aid individuals providing cardiopulmonary resuscitation and first aid shall be qualified by the American Red Cross or other recognized agencies,”

The licensee was deficient in meeting the above regulation because the personnel file did not contain documentation of a current First Aid and CPR certification, for: Employee #3.

8) Title 9, Section 10581(a) Building and Grounds Class C

The above section states, in part, “Facilities shall be clean, safe, sanitary, and in good repair at all times for the safety well-being of residents, employees and visitors.”

The licensee was deficient in meeting the above regulation because the program is not clean, safe, sanitary, and/or has damage in the following areas, for: Main, Sundown, Bunkhouse, Coral, O.T. (library and arts), Staff offices, kitchen, dining, and medication room.

• The carpet throughout the facility was dirty with black marks and debris
• The floors at the bottom of the walls around the facility were dirty with black dust buildup.
• Central air/heat vent covers are dirty with dust build up.
• The walls/ceiling throughout the facility was dirty, peeling/chipping paint, and/or damaged.
• There were baseball size holes in the walls in various areas throughout the facility.
Sundown
• There was 2″x2″ hole in the wall behind the front door.
• There was 1/2″ hole in the wall below the pay phone.
Med room
• Two 1 ½’ holes in the wall on the side of the desk.
OT – activity hall
The ceiling was damaged and missing sheet rock exposing the frame.
Bunkhouse
• There was a 2″ hole in the wall in the first room on the right side.
• The first room on the left after the hallway had a 3 ½” dent/hole in the wall nearest the window.

9) Title 9, Section 10584(e) Fixtures, Furniture, Equipment and Supplies Class B

The above section states, in part, “All toilet, hand washing facilities shall be maintained in safe and sanitary operating conditions.”

The licensee was deficient in meeting the above regulation because of the following:

• Various light fixtures were missing covers throughout the facility (Main, Sundown, and Coral).
• Sundown – Rm #3 the outlet cover was broken.

10) Title 9, Section 10584(e) Fixtures, Furniture, Equipment and Supplies Class C

The above section states, in part, “All toilets, hand washing and bathing facilities shall be maintained in safe and sanitary operating conditions.”

The licensee was deficient in meeting the above regulation because the program is not clean, safe, sanitary, and/or has damage in the following bathing areas:

• In the bathroom there was mildew around the inside/outside of the bathtub/shower (Main, Sundown, and Coral).
• Coral – the bathroom linoleum floor was peeling and splitting.
• Sundown – Rm #3 the outlet cover was broken.
