Deficiencies

1) Section 19005(b)(1) Personnel Policies

The above section states, in part,
(b) The program shall maintain personnel files on all employees. Each personnel file shall contain:
(1) Application for employment and resume.

The provider was deficient in meeting this standard because the personnel file did not contain an application or resume for employee number #1.

2) Section 19005(b)(3) Personnel Policies

The above section states, in part,
(b) The program shall maintain personnel files on all employees. Each personnel file shall contain
(3) Job description; The provider was deficient in meeting this standard because the personnel file did not contain a job description for employee number #1.

3) Section 19005(b)(5) Personnel Policies

The above section states, in part,
(b) The program shall maintain personnel files on all employees. Each personnel file shall contain:
(5) Employee evaluations;”

The provider was deficient in meeting this standard because the personnel file did not contain annual performance evaluations for employee numbers #1 and #6.

4) Section 19005(b)(6) Personnel Policies

The above section states, in part,
(b) The program shall maintain personnel files on all employees. Each personnel file shall contain:
(6) Health records including a health screening report or health questionnaire, and tuberculosis test results as required

The provider was deficient in meeting this standard because the personnel file did not contain current tuberculosis test results for employee numbers.

5) Section 19005(f) Personnel Policies

The above section states, in part,
(f) “The program shall develop and revive, as needed, Job descriptions for each employee and volunteer.”

The provider was deficient in meeting this standard because: Refer to Deficiency#2.

6) Section 19010(d) Code of Conduct

The above section states, in part, “Each staff, paid employee and volunteer shall sign a copy of the code of conduct, and the program
shall place the signed copy in the personnel file of the individual.”

The provider was deficient in meeting this standard because the personnel did not contain a signed and dated code of conduct for employee number #1.”

7) Section 19015(b)(1) Health Screening and Tuberculosis Requirements

The above section states, in part,
(b) “All staff and volunteers whose functions require or necessitate contact with participants or food preparation shall be tested for tuberculosis.
(1) The tuberculosis test shall be conducted under licensed medical supervision not more than three months prior to or seven days after employment and renewed annually from the date of the last tuberculosis test.”

The provider was deficient in meeting this standard because: Refer to Deficiency #4.

8) Section 24000 Confidentiality

The above section states,

“Programs shall assure confidentiality of the participant and the participant’s files and information in accordance with Title 42, Code of Federal Regulations, Part 2 and, when state funds are used, Health and Safety Code, Sections 11812(c) and 11977. A copy of the federal regulations shall be available at each program.”

The provider was deficient in meeting this standard because closed participant files, while in boxes, were in both the counselor and program director’s office easily accessible to participant’s and others.
