Deficiencies

1) Section 12050 Referral For Medical or Psychiatric Evaluation and Emergency Services

The above section states, In part, “The Program will have written procedures for obtaining medical or psychiatric evaluation and emergency services. All Program staff having direct contact with participants will, within the first year of employment, be trained in infectious disease recognition, crisis intervention referrals and to.recognize physical and psychiatric symptoms that require appropriate referrals to other agencies. For purposes of this section, Program staff will include Program counselors, Program specialists, Program director, Program supervisor and anyone providing alcohol and/or other drugs services to participants. The Program will have readily available the name, address, and telephone number of the fire department, a crisis center, local law enforcement, and a paramedical unit or ambulance service.”

2) Sectlon 12065 Referral Arrangements

The above section states, in part, “If during the course of recovery or treatment services, the participant is assessed and determined to be in need of additional services, the Program will provide the participant with a referral to the appropriate services, if available, Program policies and procedures will identify the conditions under which referrals are made. For each participant for whom a referral is made, an entry will be made in the participant’s file, documenting the procedure for making and following-up the referral, and the agency to which the referral was made.”

The provider was deficient in meeting the above standard because there was no ‘Referral Arrangements” policy to review.

3) Section 17010 Program Policies

The above section states, All Program policies and procedures will be contained in an operation manual that is located at each certified site and that will be available to staff and volunteers. The policies and procedures manual will contain but not be limited to the following:
* Program mission and philosophy statement(s)
* Program description
* Program objectives
* Program evaluation plan; and
* Policies and procedures for admission
* Discharge
* Individual and group sessions
* Alumni involvement
* Use of volunteers
* Recreational activities
* Detoxification services, if applicable
* Program administration
* Personnel practices
* Participant grievances/complaints
* Fiscal practices
* Continuous quality management
* Participant rights
* Nondiscrimination in provision of employment and services
* Confidentiality
* Community relations
* Maintenance of Program in a clean, safe and sanitary physical environment
* Use of prescribed medications by participants
* Maintenance and disposal of participant files
* Drug screening
* Code of conduct

The provider was deficient in meeting the above standard because the following policies were missing from the operation manual:

(7) Continuous quality management
(8) Participants rights
(9) Maintenance of Program in a clean, safe and sanitary physical environment
(10) Use of prescribed medications by participants
(11) Maintenance and disposal of participant files

4) Section 17015(b) Participant Files

The above section states, In part, “At a minimum, each participant life will contain the following: Consent to follow up.

5) Section 19005(b)(1-7) Personnel Policies

The above section states, in part, “The program shall maintain personnel files for all employees. Each personnel file shall contain:
* Application for employment and resume
* Employment confirmation statement
* Job description
* Employee evaluations

The provider was deficient in meeting the above standard because there was no resume for employee numbers 1, 2, 3, 4 and 5.

6) Section 19020 Staff Training

The above section states, “The Program will foster and encourage the continuing development of staff expertise and staff attendance at appropriate training Program. The Program will have a written plan that is annually updated, for the training needs of staff. All staff training events will be documented and maintained as part of the training plan. Staff seminars and Program will be held to discuss new developments In the field, to encourage guest participants and to provide a forum for sharing individual experiences. All events will be documented. Professional journals and other pertinent publications will be available to the staff.”

The provider was deficient in meeting above standard because there was no annual staff training plan to review.
