Section 12070 Recovery or Treatment Planning

The above section states, in part, “The program shall provide services to ensure that all program participants develop recovery or treatment plans.”

The provider was deficient in meeting the above standard because the program did not ensure that participants develop the recovery or treatment plans during admission for Resident.

Section 19005(b)(1-7): Personnel Policies

The above section states, in part, “The program shall maintain- personnel files for all employees. Each personnel file shall contain: Application for employment and resume. Employment confirmation statement. Job description. Employee evaluations”

The provider was deficient in meeting the above standard because the following Items were missing from the employees file.

(1) No evaluations for employee numbers 1, 2, 5 and 7.

Section 19015(a) Health Screening and Tuberculosis Requirements

The above section stales, “All staff and volunteers whose functions require or necessitate contact with participants or food preparation shall complete a health screening report .or health questionnaire.”

The provider was deficient in meeting the above standard because there was no health screening report or health questionnaire in the personnel file for employee numbers 1, 3, 6, and 7.

The above section states in part, “Each participant shall have rights.”

The provider was deficient In meeting the above standard because the participant rights signed by residents and posted on the wall were missing the following statements:

o To be accorded dignity in contact with staff, volunteers, board members and other persons.

o To be free from verbal, emotional, physical abuse and/or inappropriate sexual behavior.

o To be informed by the program of the procedures to file a grievance or appeal discharge.

o To be free from discrimination based on ethnic group identification religion, age, sex, color, or disability.

o To be accorded access to his or her file.

Title 9, Section 10563 Accountability Class B

The above section states, in part, “The licensee, whether an Individual or/her entity, is accountable for the general supervision of the licensed facility, and for the establishment of policies concerning its operation.”

The licensee was deficient in meeting the above regulation because the program manual does not contain documentation of a refusal policy and when a client refuses/missed medication there’s no consistency in documenting the residents’ refusal, denial or no show, and shows that medications were not being taken as prescribed, as explained to staff.

Title 9, Section 10564(c} Personnel Requirements Class B

The above section states, in part, “In addition to the requirements of Section 10564(b), program staff that provides counseling services shall be licensed, certified, or registered to obtain certification pursuant to Chapter 8 (commencing with Section 13000).”

The licensee was deficient in meeting the above regulation because the personnel record did not contain documentation of a license, certification, or registration obtain certification for Employee #6.

Title 9, Section 10567(a} Resident Health Screening Class B

The above section states, in part, “Every resident shall complete a health questionnaire.”

The licensee was deficient in meeting the above regulation because the resident file did not contain documentation of a completed health questionnaire to identify any health problem or condition which may require medical attention for resident.

Title 9, Section 10567(b) Resident Health Screening Class B

The above section states, in part, “Every resident shall be tasted for tuberculosis within six (6) months prior to or thirty (30) days after admission encl annually thereafter.”

The licensee was deficient In meeting the above regulation because the resident file did not contain documentation of an annual updated tuberculosis test for Residents.

Title- 9 , Section 10572(b) Health Related Services Class B

The above sections states, in part, “During the provision services there shall be at feast one person in the facility who is capable of providing cardiopulmonary resuscitation and first aid.”

Individuals providing cardiopulmonary resuscitation and first aid shall be qualified by the American Red Cross or other recognized agencies.

The licensee was deficient in meeting the above regulation because the personnel record did not contain documentation of a current First Aid and CPR certification for: Employees 5 and 6.

Title 9, Section 10581(a) Building and Grounds Class-C

The above section states, in part, “Facilities shall be clean, safe, sanitary and in good repair at all times for the safety and well-being of residents, employees and visitors.”

The licensee was deficient In meeting the above regulation because the program is not clean safe, sanitary, and/or has damage in the following areas:

• Base boards were dirty and dusty throughout the facility.
• The wooden borders around the walls were dirty and/or dusty throughout the facility.
• The water heaters throughout the facility were dirty and dusty around it and behind it.
• The walls were dusty and dirty In various areas of the facility.
• The wall paint was peeling around the door in the reception area.

Counselor room

• The wooden floor was badly slivered and peeling paint.
• The room with 6 resident beds – the wall behind the door as damaged by the door knob.

Title 9, Section 10584(b) Fixtures, Furniture, Equipment and Supplies Class B

The above section states, in part, “All windows screens shall being in good repair.”

The licensee was deficient in meeting the above regulation because the widows and screens were dirty throughout the facility.

Title 9, Section 10584(e) Fixtures, Furniture, Equipment and Supplies Class C

The above section states, in part, “All toilets, hand washing and bathing facilities shall be maintained in safe and sanitary operating conditions.”

The licensee was deficient in meeting the above regulation because the program is not clean, safe, sanitary, and/or has damage in the following bathing areas:

• The handicap bathroom – the wall behind the door was damaged by the door knob.
• The single toilet bathroom wall was dirty throughout.

Group room

• Bathroom paint peeling, water damage to wall behind the toilet, and there was a hole above the fire extinguisher.
• The kitchen light fixture was broken.

Senior house
• The bathroom wall paint was peeling and there was water damage on the side of sink.

. Counselor suite

• The bathroom slower was dusty/dirty Inside and out.

Counselor room

• The wooden floor was badly slivered and peeling.
• The 6 bed room – the wall behind the door was damaged by the door knob.
