Title 9, Section 10563 Accountability Class B

The above section states, in part “The licensee, whether an individual or other entity is accountable for the general supervision of the licensed facility, and for the establishment of policies concerning its operation.”

The licensee was deficient in meeting the above regulation because the front desk phones were not being answered.

The licensee was deficient in meeting the above regulation because the program manual does not contain documentation of a refusal policy.

3) Title 9, Section 10563 Accountability Class B

The above section states, in part “The licensee, whether an individual or other entity is accountable for !he general supervision of the licensed facility, and for the establishment of policies concerning its operation.”

The licensee was deficient in meeting the above regulation because if resident has a medical condition or shows signs of a communicable disease and refuses to fill-out and sign the health questionnaire what is the policy behind a refusal or an identifiable medical condition after admission as explained to staff.

4) Title 9, Section 10567(a) Resident Health Screening Class C

The above section states, in part “Every resident shall complete a health questionnaire.”

The licensee was deficient in meeting the above regulation because the reviewed resident files did not all contain documentation of a completed health questionnaire which identifies any health problems or conditions which require medical attention and/or clearance. If a resident does not want to complete a health questionnaire or refuses to the licensee shall document it.

5) Title 9, Section 10573{a)(17) Food Service Class E
The above section states, in part “All kitchen, food preparation, and storage areas shall be kept clean, free from litter and rubbish. Measures shall be taken to keep all such areas free from rodents and other vermin.”

The licensee was deficient in meeting the above regulation because the following areas were not clean, safe, sanitary, and/or has damage in the following area:

• The kitchen stove and stove air vent and fan cover were dirty and unclean with grease buildup.
• The double door refrigerator bottom shelf was dirty with liquid waste and food buildup, etc.
• The freezer bottom shelf was dirty with liquid waste and food buildup, etc.
• Kitchen ceiling was dusty and dirty.

6) Title 9, Section 10581(a) Building and Grounds Class C

The above section states, in part “Facilities shall be clean, safe, sanitary and in good repair at all times for the safety and well-being of residents, employees and visitors.”

The licensee was deficient in meeting the above regulation because the program is not clean, safe, sanitary, and/or has damage in the following areas:

• Room 1 – ceiling tile water stains.
• Intake room walls were dirty and peeling paint.
• The common area: two couches were worn and torn.
• Room 111 – hole above bed #8.
• Room 110 – hole near bed #13 and outlet cover.
• Room 106 – ceiling tile was missing.
• Room 104 – ceiling tile was unstable.

7) Title 9, Section 10584(b) Fixtures, Furniture, Equipment and Supplies Class B

The above section states, in part “All windows screens shall be in good repair.”

The licensee was deficient in meeting the above regulation because the window blinds were dirty and dusty throughout the facility.

8) Title 9, Section 10584(e) Fixtures, Furniture, Equipment and Supplies Class C

The above section states, in part ”All toilets, hand washing and bathing facilities shall be maintained in safe and sanitary operating conditions.”

The licensee was deficient in meeting the above regulation because the program is not clean, safe, sanitary, and/or has damage in the following areas: •

• The air vents were excessively dirty with dust buildup throughout the facility, bathrooms and kitchen.
• Women’s bathroom was missing a base board.
• Room 103 outlet cover was broken.
• Men’s bathroom unit 114 was dirty. .
• Janitorial closet- in front of the closet the linoleum was damaged.
• Women’s bathroom unit 112 was dirty.

Title 9, Section 10584(f}(1) Fixtures, Furniture, Equipment and Supplies Class C

The above section states, in part “All containers used for storage of solid waste shall have tight-fitting covers shall be in good repair, leak proof, and rodent proof.”

The licensee was deficient in meeting the above regulation because the containers in the kitchen and common area used for storage of solid waste did not have a tight-fitting cover.
