Deficiencies

1) Title 9, Section 10563 Accountability Class B

The above section states, “The licensee, whether an individual or other entity, is accountable for the general supervision of the licensed facility, and for the establishment of policies concerning its operation.”

The licensee was deficient in meeting the above regulation because of the following: The medication policy did not address the following:
-Specific drug identification information to be logged.
-Address whether or not a client may refuse to take their prescribed medication and/or adjust daily
-dosages; and the documentation of such refusal and/or adjustment in the “Medication Record Log”.
– Dates that medications are finished need to be logged.
– The “Medication Log Records” reviewed did not contain:
-Prescription number(s).
-Section for client to sign/initial.
-Number of pills taken at the given time.
-Dates that medications are finished.
-Numerous medication(s) were not taken as prescribed ..
-i.e., Take 1 pill, 2 times a day. Client took no pill(s). No notes in, the medication log which described why a dosage was missed or refused.

The medication destruction policy did not include specific disposal procedures

2) Title 9, Section 10564(c) Personnel Requirements Class B

The above section states, “In addition to the requirements of (b) of this regulation, program staff who provide counseling services (as defined in Section 13005) shall be licensed, certified, or registered to obtain certification pursuant to Chapter 8 (commencing with Section 13000).”

The licensee was deficient in meeting the above regulation because employees, not licensed,certified, or registered.

3) Section 10564{e) Personnel Requirements Class B

The above section states, in part, “All personnel shall be in good health verified by a health screening, including a test for tuberculosis, performed under licensed medical supervision not more than sixty (60) days prior to or seven (7) days after employment with tuberculosis testing renewable every year.

The licensee was deficient in meeting the above regulation because the personnel records for employees and did not contain a health screening and employee did not contain a current tuberculosis test result.

4) Section 10564(I)(3)(A) Personnel Requirements Class B

The above section states, in part, “The licensee shall maintain personnel records for all staff containing: Personnel records for staff who provide counseling services shall also contain: Written documentation of Iicensure, certification, or registration to obtain certification… ”

The licensee was deficient in meeting the above regulation because personnel records for employees 1 and 1 did not contain written documentation of licensure, certification, or registration to obtain certification.”
